Terms of service

These Terms of Service and other various regulations (the details of which are stipulated in Article 1; hereinafter collectively referred to as "these Terms") define the matters to be observed by users and the relationship of rights and obligations between Brave group Inc. (hereinafter referred to as "Brave") and users in using the "Iida Pochi. Official Store" (hereinafter referred to as "this Site") operated by Brave. By using this Site, the user shall be deemed to have agreed to the latest version of these Terms at that point in time. Since Brave reserves the authority to modify these Terms as necessary, anyone intending to use this Site must read the full text carefully and fully understand it before using this Site.

Article 1 (Definitions, etc.)

Definitions of terms used in the Use Agreement shall be as follows:

(1)"These Terms" means the collective term for these Terms of Service, policies regarding this Site posted by Brave on this Site from time to time (including, but not limited to, the Refund Policy, Shipping Policy, Privacy Policy, etc.), and other various regulations. If there is any contradiction or conflict between the content of these Terms of Service and the policies regarding this Site or other regulations posted on this Site from time to time, the provisions of the policies regarding this Site or other regulations shall take precedence and apply.

(2)"This Site" means the collective term for "Iida Pochi. Official Store" and other websites published by Brave in connection with this Site.

(3)"Use Agreement" means the agreement for the use of this Site incorporating these Terms, which is naturally concluded between Brave and a user when the user uses this Site (including browsing, purchasing, receiving gifts, and any other acts of use; the same shall apply hereinafter).

(4)"Products" means products handled on this Site (including digital data, rights to receive services, and all other items sold on this Site).

(5)"Intellectual Property Rights" means copyrights (including the rights under Articles 27 and 28 of the Copyright Act, neighboring rights, and author's moral rights), patent rights, utility model rights, trademark rights, design rights, and other intellectual property rights (including the right to acquire those rights or apply for registration, etc. for those rights).

(6)"Minors, etc." means minors, adult wards, persons under curatorship, or persons under assistance, and "Legal Representatives, etc." means legal representatives, guardians, curators, or assistants.

(7)"Anti-Social Forces" means organized crime groups (boryokudan), members of organized crime groups, quasi-members of organized crime groups, companies related to organized crime groups, corporate racketeers (sokaiya), groups masquerading as social movements, special intelligence organized crime groups, and other parties equivalent to these.

Article 2 (Amendments to these Terms, etc.)

1.Brave may amend these Terms at any time if Brave deems it necessary, and users shall comply with such amendments. However, if any material content of these Terms is amended, Brave will notify users in advance by a method that Brave deems appropriate. If a user uses this Site after an amendment to these Terms, the user shall be deemed to have agreed to the amended Terms, and the content of the Use Agreement shall also be amended in accordance with the amended Terms.

2.If Brave and a user establish special provisions regarding the use of this Site through an explicit written agreement, such special provisions shall take precedence and apply over these Terms.

Article 3 (Notifications and Communications)

1.Notifications or communications from Brave to users regarding this Site shall be made by posting them in an appropriate place within the website or application operated by Brave, or by any other method that Brave deems appropriate. When Brave deems it necessary to notify or communicate with individual users, Brave may send notifications or communications to the registered email address, address, or telephone number using messaging functions, email, postal mail, telephone, etc.

2.Communications and inquiries regarding this Site shall be made through the contact form or the email address designated by Brave. Upon receipt of such communication or inquiry, Brave may verify the identity of the user by a method determined by Brave if Brave deems it necessary. In addition, Brave will respond to and answer the contents of the communication or inquiry within a reasonable scope; however, depending on the contents of the communication or inquiry, Brave may not be able to respond, or it may take time to reply.

Article 4 (Management of Account Information)

1.Users shall, at their own responsibility, manage and store their IDs and passwords pertaining to this Site (hereinafter referred to as "Account Information"), and must not allow third parties to use them, nor lend, transfer, change the name of, buy, or sell them. In addition, users shall ensure that registered users strictly manage and store their Account Information, and must not allow third parties to use it, nor engage in acts such as lending, transferring, changing the name of, buying, or selling it.

2.The user shall bear full responsibility for any damage caused by insufficient management of Account Information, errors in use, use by third parties, etc., and Brave shall not bear any responsibility whatsoever.

3.If a user discovers that their Account Information has been stolen or is being used by a third party, the user shall immediately notify Brave to that effect and follow instructions from Brave.

Article 5 (Purchase of Products)

1.Users may purchase Products on this Site provided that they comply with the Use Agreement. The prices of Products and the methods of payment shall be as displayed by Brave on this Site. Please note that some Products may be available exclusively online, and quantities or sales periods may be limited. In addition, Brave may separately establish individual sales conditions for each Product (which will be described on individual product pages, etc.).

2.When purchasing Products on this Site, users agree to provide the latest, complete, and accurate information (email address, credit card number, expiration date, Account Information, and other information) in accordance with Brave's request. The user shall bear full responsibility for any damage caused by deficiencies in such information, and Brave shall not bear any responsibility whatsoever. Furthermore, by ordering Products, the user shall be deemed to have represented and warranted that, if they are a Minor, etc., they have obtained the consent of their Legal Representative, etc., and that they do not violate any of the prohibited acts in Article 7. If a user is a Minor, etc., please order Products after obtaining the consent of a Legal Representative, etc.

3.While Brave endeavors to display the sales conditions, colors, images, etc. of the posted Products as fully and accurately as possible, Brave does not guarantee that the sales conditions will not change afterward, that the colors and images will be accurately displayed on your computer monitor, that the Products will meet your expectations, or that any bugs or errors contained in the Products will be corrected.

4.If there is an error in the contents of an order transmitted to Brave through online ordering, Brave cannot accommodate any requests from the user, except in cases attributable to the fault of Brave.

5.Brave reserves the right, in its sole discretion, to refuse or limit orders that Brave deems inappropriate, such as orders that appear to be placed by dealers, resellers, or distributors.

6.Warranty services will be provided in accordance with the conditions stated in the warranty certificate and other documents attached to the Products. Product warranty conditions may be posted on each product page, so please review the details carefully.

7.Unless otherwise specified, all fees and payments for transactions on this Site shall be made in the currency specified on this Site and based on the payment method selected by the user. Settlement procedures related to currency conversion and foreign transaction fees shall apply in accordance with the terms and conditions of the financial institution or payment service provider providing the payment method.

Article 6 (Information Posted by Users)

1.Brave may provide a function on this Site for users to post information such as reviews. Brave will update such information posted by users from time to time, but does not guarantee the frequency of updates or immediate reflection on the Site.

2.If Brave deems that information posted by a user is inappropriate for posting on this Site due to a violation of these Terms or for other reasons, Brave will take actions such as not posting all or part of the information, changing the scope of disclosure, or requesting the poster to make corrections, and the poster shall cooperate with such actions.

3.If Brave determines that any of the following applies, Brave may delete all or part of the relevant information from this Site or take the actions prescribed in the preceding paragraph, regardless of whether the information is illegal or violates these Terms:

(1) If a public institution or expert (the government, a local public entity, a reliability verification organization prescribed in the guidelines of the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Disclosure of Identification Information of the Senders, an internet hotline, an attorney, etc.) points out or expresses an opinion that the posted information is illegal, violates public order and morals, or infringes upon the rights of others;

(2) If a person claiming to be a right holder reports that the posted information infringes upon their rights.

4.Even if a user terminates their use of this Site, each of the above provisions shall remain in effect, and the user shall not be able to edit or delete content posted prior to the termination of their use of this Site.

Article 7 (Prohibited Acts)

1.In connection with the use of this Site, users must not engage in any of the acts specified in the following items:

(1) Acts that violate or are likely to violate the Use Agreement;

(2) Reselling or otherwise distributing Products without the prior express written consent of Brave, regardless of whether it is for commercial purposes or financial gain;

(3) Acts of using this Site beyond the scope of use permitted by Brave on this Site;

(4) Acts that infringe or are likely to infringe upon the copyrights or other intellectual property rights, honor, privacy, portrait rights, business rights, or other rights or interests of Brave or a third party;

(5) Acts that cause or are likely to cause loss or damage to Brave or a third party;

(6) Acts related to criminal behavior or acts that violate public order and morals;

(7) Acts that violate laws and regulations or the internal rules of the industry association to which Brave or the user belongs;

(8) Acts of destroying, interfering with, or altering information available regarding this Site, or Brave's systems, data, or networks;

(9) Acts of analyzing or performing reverse engineering on this Site or Brave's systems;

(10) Acts of transmitting data exceeding a certain data capacity specified by Brave through this Site;

(11) Acts of unauthorized rewriting or erasing of information stored in Brave's equipment;

(12) Acts of using this Site by impersonating someone other than the user themselves, pretending to have the right of representation or agency or consent from a Legal Representative, etc. regarding the acts of a Minor, etc. despite not having such right or consent, or falsely claiming an affiliation or cooperative relationship with another person or organization;

(13) Acts that promote discrimination or violate public order and morals;

(14) Acts that cause a major hindrance to Brave's operations, such as making telephone calls or inquiries for a long duration or an excessive number of times;

(15) Acts that are likely to interfere with Brave's operation of this Site;

(16) Acts equivalent to any of the preceding items, or acts that Brave reasonably deems inappropriate for a user.

2.If a user receives a claim from or arises a dispute with another user, an external operator, or any other third party in connection with this Site, the user shall immediately notify Brave of the contents thereof, handle the claim or dispute at the user's own expense and responsibility, and report the progress and results to Brave based on a request from Brave.

3.If Brave reasonably determines that a user has violated, is violating, or is likely to violate the Use Agreement, Brave may, without prior notice or demand, immediately suspend the use of this Site by such user, cancel orders for Products, or refuse the use of this Site, or take any other measures that Brave deems appropriate. Brave shall not disclose the reasons for such suspension, cancellation, refusal, etc., unless Brave deems it particularly necessary, and Brave shall not bear any responsibility whatsoever for any damage caused to the user due to acts performed by Brave based on this Article.

4.If a user engages in an act that violates the Use Agreement, the user shall bear all responsibilities arising from such act, and Brave shall not bear any responsibility whatsoever. If Brave suffers any damage, Brave may demand compensation from the user for such damage (including damages paid to third parties, attorneys' fees, and other expenses incurred by Brave for dispute resolution).

5.Brave cuts off all relationships with Anti-Social Forces. Therefore, users shall use this Site after representing and warranting that they are not Anti-Social Forces and do not have any socially condemnable relationship or involvement with Anti-Social Forces, such as cooperating or being involved in the maintenance, operation, or management of Anti-Social Forces through the provision of funds or otherwise. If Brave determines that a user has violated or is likely to violate such representation and warranty, Brave may take the measures prescribed in paragraph 3.

Article 8 (Attribution of Rights)

All intellectual property rights regarding this Site and Products belong to Brave or those who have granted licenses to Brave. The conclusion of the Use Agreement and the provision of Products to users do not transfer or license any intellectual property rights or any other rights pertaining to this Site or Products to users, except for those explicitly stated in advance in the Use Agreement, such as permission to use within a certain scope. Under no circumstances shall users engage in acts that are likely to infringe upon the intellectual property rights of Brave or those who have granted licenses to Brave (including, but not limited to, use outside the permitted scope of Products, disassembly, decompilation, and reverse engineering).

Article 9 (Provision of Services Outside Japan)

Brave may provide services outside Japan, and even in such cases, Brave will, in principle, provide services in accordance with the provisions of these Terms. However, if there are special legal requirements or provisions in each destination country regarding copyrights or other intellectual property rights, personal information protection, or other laws and regulations, Brave shall comply with the laws and regulations of the respective countries, and Brave will take appropriate actions based on such laws and regulations. In addition, in some regions, including the United States, separate policies may be established to comply with local laws. Article 10 (Use of Information)

1.Brave may acquire information regarding the manner of use of this Site by users (meaning all information about users acquired by Brave, such as device-specific information and device location information of mobile terminals using this Site, users' IP addresses, usage status, history, etc., including users' behavioral information within this Site acquired using tools provided by third parties), create statistical or aggregated data thereof, and freely use such information and data for the improvement of this Site or the appropriate operation of this Site, with or without linking it to the personal information of users, without charge (including performing analysis and management by itself or by entrusting it to a third party).

2.Notwithstanding the preceding paragraph, Brave shall handle users' personal information ("Personal Information" as defined in the Act on the Protection of Personal Information) in accordance with the Privacy Policy.

3.This Site is hosted by Shopify Inc., which collects and processes personal information regarding your access to and use of the services in order to provide and improve services to you. Information you submit to the services will be transmitted to and shared with Shopify and third parties, which may be located in countries other than your country of residence, for the purpose of providing and improving services to you. Furthermore, in order to protect, expand, and improve our business, we use certain enhanced features of Shopify that incorporate data and information obtained when you interact with this Site, other merchants, and Shopify. Article 11 (Disclaimer of Warranties)

1.Users shall agree in advance that Brave makes no warranty to users regarding the fitness for a particular purpose intended by users, completeness, continuity, usefulness (benefit), etc., of Products purchased on this Site.

2.Users shall investigate and comply with whether using this Site and all acts performed using this Site violate laws and regulations applicable to users, internal rules of industry associations, etc., based on their own responsibility and expense. Brave does not guarantee in any way that the use of this Site by users conforms to laws and regulations applicable to users, internal rules of industry associations, etc.

3.Brave shall not bear any responsibility if a user's use of this Site causes problems or damage to the user's mobile terminals, computer equipment, etc., or if information, programs, etc. recorded in such equipment are lost or malfunction, or if any other disadvantage or loss (including virus infection) is caused to the user. Even if this Site does not operate or cannot be used due to communication environment conditions, etc., Brave shall not bear any responsibility, including support, etc.

4.This Site is hosted by Shopify Inc. The company provides us with an online e-commerce platform to sell products and services. In addition, this Site may link with external services provided by third parties, but Brave does not guarantee linkage with specific external services. Even if this Site cannot link with an external service, or if the use of part or all of this Site is restricted due to unexpected changes in specifications, etc. of an external service (including cases where unexpected behavior occurs on this Site), Brave shall not bear any responsibility, unless such restriction of use is caused by the intentional act or gross negligence of Brave.

5.In cases where this Site links with external services, users shall comply with the terms of service, etc. of the external services at their own expense and responsibility. Transactions, communications, disputes, etc. arising between a user and an external operator operating the external service, other users, or any other third party shall be handled and resolved at the responsibility of the user, and Brave shall not bear any responsibility for such disputes, etc., unless caused by the intentional act or gross negligence of Brave.

6.Users agree in advance that advertisements may be displayed during the use of this Site, that such advertisements may be displayed using third-party advertisement distribution operators in addition to those by Brave, and that third-party advertisement distribution operators used by Brave may use Cookies to distribute advertisements within this Site based on past access information to this Site or external sites. Brave shall not bear any responsibility even if damage occurs to a user in connection with such advertisements.

7.Even in cases where Brave bears liability for damages for losses suffered by a user in connection with this Site notwithstanding the disclaimers stipulated in the Use Agreement, Brave's liability for damages shall be limited to direct and ordinary damages actually suffered by the user, and the upper limit shall be the amount equivalent to the price of the Products pertaining to the sales contract that caused the damage. However, this shall not apply if the damage is directly caused by the intentional act or gross negligence of Brave.

Article 12 (Temporary Suspension of this Site)

1.Brave may suspend or interrupt the use of all or part of this Site without prior notice to users in any of the following cases:

(1) When performing periodic or emergency inspection, maintenance work of the computer systems pertaining to this Site, or work for version upgrades of this Site;

(2) When computers, communication lines, etc. stop due to an accident;

(3) When the operation of this Site becomes impossible due to force majeure such as fire, power outage, or natural disasters;

(4) When troubles, interruption or suspension of service provision, suspension of linkage with this Site, changes in specifications, etc. occur in external services;

(5) In any other cases where Brave deems suspension or interruption necessary.

2.Brave may change all or part of the contents and specifications of this Site if Brave deems it necessary. Brave shall not bear an obligation to obtain consent from users for such changes, etc., and shall notify users of the contents and timing of the changes by a method Brave deems appropriate.

3.Brave shall not bear any responsibility for damages caused to users based on measures taken by Brave pursuant to this Article.

Article 13 (Assignment of this Site, etc.)

1.Users may not assign, transfer, grant security interests in, or otherwise dispose of their status under the Use Agreement or their rights or obligations based on the Use Agreement to a third party without the prior written consent of Brave.

2.In cases where Brave transfers the business pertaining to this Site to a third party (regardless of the form, such as business transfer, company split, etc.), Brave may assign its status under the Use Agreement, rights and obligations based on the Use Agreement, and registered information of users and other customer information to the transferee of such transfer, and users shall be deemed to have agreed in advance to such transfer in this paragraph.

Article 14 (Entire Agreement)

These Terms constitute the entire agreement between Brave and users regarding the matters contained in these Terms, and shall take precedence over any prior agreements, representations, and understandings between Brave and users, whether oral or written, regarding the matters contained in these Terms, except as otherwise separately provided in these Terms.

Article 15 (Language)

Even if different language versions are established for all or part of these Terms, versions other than the Japanese version shall be for reference purposes only, and the Japanese version shall apply.

Article 16 (Severability)

Even if any provision of these Terms or a part thereof is determined to be invalid or unenforceable under laws and regulations, the remaining provisions of these Terms and the remaining portion of the provision determined to be invalid or unenforceable shall continue to remain fully effective. Brave and users shall endeavor to modify such invalid or unenforceable provision or portion to the extent necessary to make it lawful and enforceable, and to ensure the intent and legally and economically equivalent effects of such invalid or unenforceable provision or portion.

Article 17 (Governing Law and Jurisdiction)

The formation, validity, performance, and interpretation of the Use Agreement shall be governed by the laws of Japan. In addition, Brave and users agree that any lawsuit filed in connection with the Use Agreement shall be subject to the exclusive agreed jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance, depending on the amount of the lawsuit.

Article 18 (Consultation)

For matters not stipulated in these Terms or when doubts arise regarding the interpretation of these Terms, Brave and users shall consult with each other in good faith to seek a resolution.
